Tara Fowler of Torbay Council admits to Leon Butler trigger thresholds exceeded during September but hides the failure to implement agreed emergency arrangements by claiming a 24 hour average was ‘agreed’ as part of the pre-commencement Planning Conditions.
Leon Butler has investigated this and provides the evidence that shows the agreed threshold is an hourly average. This is in line with common sense and the agreed monitoring protocols produced by Linden Homes’ air quality monitoring contractor RAW.
The statement stands that trigger and incident level dust emissions were frequently exceeded during September. Torbay Council has therefore been negligent in not properly monitoring the site and implementing agreed control measures to protect the community and the children at the school.
We call on the Council to accept their failures and publish all the data on toxic dust release and put a plan in place to prevent further breaches of agreed protocols.
